Prohibited Items Policy
Prohibited Items Policy
A clear, transparent account of what we do not sell — and why. Grounded in US federal law, Canadian consumer regulations, and responsible retail practice.
What This Policy Covers
At Your Hair And Wig, every product listed on yourhairandwig.com goes through a careful review before it is offered for sale. This policy describes the categories of items and product types we do not list, stock, or ship to customers in the United States and Canada — and explains the specific laws, regulations, and safety standards that inform those decisions.
We ship exclusively to addresses in the United States and Canada. Any product that is legally prohibited, restricted without proper licensing, or unsafe for general consumer sale in either jurisdiction is not available on our platform. This is not a negotiable position; it is a core operating standard we maintain at all times.
This policy applies to all wigs, lace fronts, weaves, hair care products, styling tools, accessories, and any other items listed in our catalog. If a customer believes a listed item may conflict with any section of this policy, we encourage them to contact our team directly.
Governing Laws & Regulations
This policy is informed by, and kept current with, the following primary authorities:
- FTC Fair Packaging and Labeling Act (15 U.S.C. §§ 1451–1461)
- Modernization of Cosmetics Regulation Act of 2022 (MoCRA)
- FDA Federal Food, Drug, and Cosmetic Act (FD&C Act)
- California Safe Cosmetics Act (Health & Safety Code §§ 111791–111793)
- Health Canada Cosmetic Regulations (SOR/2016-121)
- Canada Consumer Product Safety Act (CCPSA, S.C. 2010, c. 21)
Categories We Do Not Sell
The following product categories are permanently excluded from our catalog. These exclusions exist to protect our customers, comply with applicable law, and maintain the integrity of our business.
Counterfeit or Unauthorized Branded Goods
We do not list, stock, or ship any product that bears, imitates, or falsely claims a registered trademark belonging to another brand without a valid and documented authorization agreement. This includes imitation designer hair accessories, unauthorized replica styling tools, or counterfeit branded hair care products. All branded products on our site are sourced directly from verified suppliers or authorized distributors.
Products Making Unapproved Drug or Medical Claims
Under the FDA's Federal Food, Drug, and Cosmetic Act, a product that claims to treat, cure, or prevent a scalp or hair disease — such as alopecia, seborrheic dermatitis, or androgenic hair loss — is classified as a drug and requires an approved New Drug Application (NDA) or an OTC monograph. We do not sell any product that makes drug-level claims without valid FDA approval or recognized OTC monograph status.
Products Containing Prohibited or Restricted Chemicals
Certain chemicals found in some hair straightening or chemical relaxer products — including formaldehyde above regulatory thresholds, methylene glycol, and certain endocrine-disrupting compounds — are banned or strictly controlled by the FDA, the California Safe Cosmetics Program, and Health Canada. We do not sell any hair care formulation that contains these substances at levels that exceed legal limits in the US or Canada.
Unlabeled or Mislabeled Human Hair Products
The FTC's Hair Fiber Products Labeling regulations (16 C.F.R. Part 257) require that products containing human hair must clearly disclose this on the label. The use of language such as "100% human hair," "Remy hair," or "virgin hair" without truthful substantiation is a violation of FTC rules. We do not list wigs, weaves, or extensions that carry false or unsubstantiated fiber composition claims. Every hair product in our catalog accurately represents its fiber content.
Products Bearing False or Misleading Advertising Claims
The FTC Act (15 U.S.C. § 45) prohibits unfair or deceptive acts in commerce. Canada's Competition Act (R.S.C. 1985, c. C-34, Section 74.01) similarly prohibits misleading representations. We do not list any product whose description contains fabricated customer reviews, false before-and-after claims, inflated original prices used to manufacture artificial discounts, or any health benefit claim that is not truthfully substantiated by competent scientific evidence.
Non-Cosmetic Scalp or Hair Treatment Devices Requiring Clearance
Certain electronic hair and scalp treatment devices — such as laser hair growth helmets or low-level laser therapy (LLLT) devices — are classified as medical devices by the FDA (21 C.F.R. Part 880) and require 510(k) clearance or premarket approval before legal sale in the US. In Canada, such devices require a Medical Device License under the Medical Devices Regulations (SOR/98-282). We do not sell medical devices without verified regulatory clearance in both jurisdictions.
Products Sourced from Suppliers Under Sanctions or Import Restrictions
The US Office of Foreign Assets Control (OFAC) and Global Affairs Canada maintain sanctions lists that prohibit the importation and sale of goods from certain countries or entities. We conduct ongoing due diligence on our supply chain to ensure no product in our catalog originates from a sanctioned source. Any supplier found to be on a sanctions list is immediately removed from our sourcing arrangements.
Products Not Compliant with MoCRA Registration Requirements
The Modernization of Cosmetics Regulation Act of 2022 (MoCRA) requires all cosmetic product manufacturers and facilities that manufacture cosmetics for US distribution to register with the FDA. Cosmetic products must also be listed with the FDA. Effective December 29, 2023, any cosmetic sold in the US must comply with these requirements. We verify supplier MoCRA compliance and do not list cosmetic products from unregistered manufacturers.
Recalled or Safety-Flagged Products
We monitor the FDA's MedWatch safety recall database, the Consumer Product Safety Commission (CPSC) recall database, and Health Canada's consumer product recall list. Any product subject to an active recall, safety advisory, or market withdrawal is immediately removed from our listings. We do not re-list recalled products without written confirmation that the recall has been resolved and the product has been cleared for sale by the relevant regulatory body.
Hair Fiber Labeling: What the Law Requires
The Federal Trade Commission's Textile Fiber Products Identification Act (15 U.S.C. §§ 70–70k) and the separate Hair Fiber Products Labeling provisions (16 C.F.R. Part 257) impose specific disclosure duties on retailers who sell wigs, hairpieces, extensions, and weaves. These rules exist to ensure buyers know exactly what they are purchasing before completing a transaction.
At Your Hair And Wig, every wig, lace front, weave, or extension listing on our site includes accurate fiber composition disclosure. We do not permit vague or unverifiable descriptions such as "premium blend" or "salon-grade human hair" unless the listing can substantiate those claims with documented supplier certificates.
The following specific representations are prohibited in our listings:
- Claiming "100% human hair" for products that contain any synthetic fiber blend
- Using the term "Remy" or "virgin hair" without verifiable provenance documentation
- Omitting the fiber content entirely from the product listing or product packaging
- Listing synthetic hair at the same price tier as documented human hair without explanation
Accurate Fiber Types We Carry
- Synthetic Fiber Wigs & Extensions — clearly labeled as synthetic, heat-resistant synthetic, or kanekalon fiber
- Human Hair Wigs & Lace Fronts — labeled as 100% human hair only when supplier documentation confirms this
- Blended Hair Products — percentage of human and synthetic fiber clearly disclosed in the product description
- Head Scarves & Accessories — fabric composition (cotton, polyester, silk blend, etc.) disclosed per FPLA requirements
Country of Origin Disclosure
All products sold on yourhairandwig.com include country of origin disclosure as required by 19 U.S.C. § 1304 and corresponding Canadian Textile Labelling Act (R.S.C. 1985, c. T-10) provisions. Products that do not meet origin-marking requirements are not listed for sale.
Restricted Chemicals & Prohibited Ingredients
We do not stock hair care formulations — including shampoos, conditioners, scalp treatments, styling products, or chemical relaxers — that contain any of the following restricted or prohibited substances at concentrations above the applicable regulatory threshold in the US or Canada.

California Proposition 65 (Safe Drinking Water and Toxic Enforcement Act of 1986): California law requires businesses to warn consumers before exposing them to chemicals listed by the State as known to cause cancer, birth defects, or other reproductive harm. All products we ship to California-based customers comply with Prop 65 warning requirements where applicable. We do not list products that contain Prop 65-listed chemicals at actionable concentrations without the required consumer warning.
Cosmetics vs. Drugs: Where We Draw the Line
One of the most important compliance distinctions in beauty retail involves the difference between a cosmetic product and an OTC drug. Getting this wrong exposes both retailers and customers to serious risk.
What Counts as a Cosmetic
Under Section 201(i) of the FD&C Act, a cosmetic is a product intended to be applied to the human body to cleanse, beautify, promote attractiveness, or alter appearance without affecting the body's structure or functions. Our shampoos, conditioners, hair oils, styling products, and leave-in treatments fall into this category and are sold as cosmetics only.
A product becomes a drug under US law the moment its labeling or advertising claims it will affect the structure or function of the body — for example, "stimulates hair follicle growth," "reverses hair thinning caused by DHT," or "clinically proven to regrow lost hair." We do not list any product using this type of language unless it holds valid FDA approval or OTC monograph status.
Cosmetic Claims We Permit
We permit truthful cosmetic-grade claims that describe what a product does on the surface of the body — claims like "moisturizes the hair shaft," "adds shine and softness," "detangles and smooths," "protects against heat styling damage," or "cleanses the scalp." These claims are appropriate for cosmetic products and do not convert a cosmetic into a drug under FDA rules.
We also permit structure-neutral wellness language such as "strengthens the appearance of weak hair" or "helps hair look and feel thicker," provided these claims are not accompanied by any implication that the product is changing the biological hair growth cycle or treating an underlying medical condition.
Drug-Level Claims That Exclude a Product
Any product whose description on our platform would include language such as "treats alopecia," "prevents pattern baldness," "promotes hair regrowth after chemotherapy," "reduces DHT activity at the follicle," or similar is automatically excluded from our catalog unless verified OTC drug or NDA approval documentation is provided. No exceptions are made for this category.
The same standard applies to Canadian regulation. Health Canada classifies natural health products and drugs under the Natural Health Products Regulations (SOR/2003-196) and the Food and Drugs Act. Products making therapeutic claims without a valid Natural Product Number (NPN) or Drug Identification Number (DIN) are not listed for Canadian customers.
Hair Growth Oils: Our Position
Your Hair And Wig carries a curated selection of hair growth oils — including products containing castor oil, rosemary oil, jojoba oil, and other plant-derived ingredients. These products are sold as cosmetics that may support the appearance of fuller, healthier-looking hair when used consistently as directed.
None of the hair growth oils in our catalog are represented as treatments for medically diagnosed hair loss conditions. Product descriptions are vetted to ensure they reflect cosmetic positioning only. If any product description visible on our site appears to make a medical claim, we ask customers to report it to us immediately at info@yourhairandwig.com so we can correct the listing promptly.
US & Canadian Regulatory Requirements
Because we ship to both the United States and Canada, our catalog must meet the requirements of both federal systems, plus applicable US state-level rules. Here is a detailed breakdown of our compliance obligations in each jurisdiction.
- MoCRA (2022): All cosmetics must originate from FDA-registered facilities. Manufacturers must maintain safety substantiation records for every product. We verify this before listing any new supplier's cosmetic product.
- FTC Act § 5: All product claims must be truthful, non-deceptive, and substantiated prior to publication. This includes pricing representations, discount claims, and customer review authenticity.
- California SB 574 (Toxic-Free Cosmetics Act, 2020): Prohibits 24 specific chemicals in cosmetics sold to California residents, effective January 1, 2025. We do not list any formulation that contains these ingredients for US-wide sale.
- CPSC Consumer Product Safety Act (15 U.S.C. § 2051): Styling tools, electrical appliances, and heat styling devices sold on our site must meet CPSC electrical safety standards and carry appropriate UL or ETL certifications.
- Lanham Act (15 U.S.C. § 1051): Trademark and brand representation compliance. No product on our site falsely claims affiliation with or endorsement by any brand that has not authorized such claims in writing.
- Minnesota S.F. 4428 (Cosmetics Safety Act, 2023): Restricts 11 additional ingredients in cosmetics sold in Minnesota. Our catalog is reviewed against this list for compliance where relevant.
- Cosmetic Regulations (SOR/2016-121): All cosmetics sold in Canada must be notified to Health Canada within 10 days of first sale. Manufacturers must disclose all ingredients in descending order of concentration. We ensure all cosmetics we ship to Canada meet these notification requirements.
- Health Canada Cosmetic Ingredient Hotlist: Canada maintains a list of ingredients that are prohibited, restricted, or subject to conditions of use in cosmetics. We do not ship any product containing Hotlist-prohibited ingredients to Canadian addresses.
- Canada Consumer Product Safety Act (S.C. 2010, c. 21): Consumer products must not pose an unreasonable danger to the health or safety of persons. CPSA applies to all non-cosmetic consumer goods including hair accessories, styling tools, and head coverings.
- Textile Labelling Act (R.S.C. 1985, c. T-10): All textile products (scarves, wigs, weaves) shipped to Canada must be labeled with the generic name of each fiber present in amounts greater than 5%, the percentage of each fiber by mass, and the country of origin, in both English and French.
- Competition Act (R.S.C. 1985, c. C-34): Prohibits misleading advertising, deceptive pricing practices, and false or misleading representations that could influence purchasing decisions. All product pricing, discounts, and promotional language on our site complies with Competition Act standards.
- Canada's Anti-Spam Legislation (CASL, S.C. 2010, c. 23): All commercial electronic messages sent to Canadian customers are sent only with express or implied consent and include an unsubscribe mechanism. This is distinct from our product policy but reflects our overall commitment to Canadian legal compliance.
Pricing Integrity & Anti-Deception Standards
Deceptive pricing is one of the most closely scrutinized areas in e-commerce by both the FTC in the United States and the Competition Bureau in Canada. At Your Hair And Wig, we maintain clear, honest, and verifiable pricing across our entire catalog.
We do not use inflated "original" or "compare at" prices that were never actually charged in a genuine transaction. If a sale price is displayed alongside a higher reference price, that higher price reflects a price at which the product was genuinely offered for sale for a meaningful period — consistent with FTC pricing guidance (16 C.F.R. § 233) and the Canadian Competition Act Section 74.01(3) provisions on deceptive regular price representations.
We do not employ countdown timers that reset after expiry to create false urgency, and we do not display false stock scarcity warnings. Where a product is genuinely low in stock, that statement reflects actual inventory levels at the time the page is displayed.
What You Will Always See on Our Site
- Accurate, current pricing displayed in USD or CAD depending on your region selection
- Clear disclosure of applicable taxes and shipping costs prior to checkout
- Genuine discount percentages that reflect real price reductions from prior list prices
- Product reviews that are unfiltered, unmanipulated, and represent real customer experiences
- A clear, accessible refund and return policy linked from every product page
FTC Endorsement & Review Disclosures
In accordance with the FTC's revised Endorsement Guides (16 C.F.R. Part 255, effective August 2023), any paid partnership, affiliate relationship, or product gifting arrangement that influences a review or endorsement visible on our platform is clearly disclosed. We do not suppress negative reviews or publish reviews from users who received undisclosed compensation without a visible disclosure statement.
