What This Policy Covers

At Your Hair And Wig, authenticity is not a marketing claim — it is an operating requirement we apply before any product reaches yourhairandwig.com. This policy explains what we mean by "counterfeit" and "non-genuine," the standards we hold every supplier to, and the United States and Canadian laws that shape those standards.

Our catalog includes human hair and synthetic wigs, lace fronts, weaves, and extensions, alongside hair care formulas, styling tools, and accessories manufactured by a range of third-party brands. Whether an item is one of our own curated listings or a recognized manufacturer's product, the same authenticity standard applies without exception, and no listing is permitted to imply it is something it is not.

We ship exclusively to the United States and Canada, and this policy is written to reflect the consumer-protection and intellectual-property frameworks of both countries. If a customer, supplier, or brand owner ever has reason to question whether a listed product is genuine, we want to hear about it directly — contact our team at any time.

Governing Laws & Regulations

This policy is informed by, and kept current with, the following primary authorities:

  • Lanham Act, including §32 and §43(a) (15 U.S.C. §§ 1114, 1125)
  • Stop Counterfeiting in Manufactured Goods Act (18 U.S.C. § 2320)
  • Tariff Act of 1930, § 526 (19 U.S.C. § 1526) & 19 C.F.R. Part 133
  • FTC Act § 5 (15 U.S.C. § 45)
  • Canada Trade-marks Act (R.S.C. 1985, c. T-13), as amended by the Combating Counterfeit Products Act (S.C. 2014, c. 32)
  • Canada Copyright Act (R.S.C. 1985, c. C-42)
  • Canada Competition Act (R.S.C. 1985, c. C-34), ss. 52 & 74.01

What Authenticity Means at Your Hair And Wig

These nine commitments govern every product we add to our catalog, every supplier we work with, and every claim we publish on a product page. They apply equally to our own curated listings and to the third-party manufacturer brands we carry.

Zero Tolerance for Counterfeit Goods

We do not list, stock, or ship any product bearing a trademark or logo that is identical to, or substantially indistinguishable from, a brand it does not genuinely come from. A counterfeit item — regardless of how it is described — is removed the moment it is identified, and the supplying source is reviewed.

Verified Supplier & Manufacturer Relationships

Every supplier in our sourcing network is reviewed for business legitimacy — including basic incorporation and contact verification, manufacturing or distribution documentation, and confirmation that they are entitled to sell the specific products they offer — before a single item from that supplier is listed.

Genuine Third-Party Branded Products

Our hair care, styling tool, and treatment categories include products manufactured by independent third-party brands. We purchase this inventory through channels that connect back to the manufacturer or an authorized distributor, and we do not knowingly source "branded" goods from sellers offering pricing or terms typical of unauthorized or counterfeit supply.

Human Hair Origin & Provenance Standards

For human hair wigs, lace fronts, weaves, and extensions, we require supplier documentation describing how the hair was collected and processed before we publish claims such as "Remy hair" or "virgin hair" on a listing. Unsubstantiated provenance claims are not permitted on our site.

No Counterfeit-Indicating Language

We do not publish listings that use words like "replica," "knockoff," "dupe," "inspired by [Brand]," "clone," "faux," or "mirror image" to describe an item in relation to a trademarked product. Language of this kind signals an imitation product and has no place in our catalog.

Truthful Trademark References Only

When a product page references a manufacturer's brand name — for example, to identify which company actually made a styling tool or hair care formula — that reference is for accurate identification only. We do not use a brand name to imply sponsorship, certification, or an official partnership that does not exist.

Packaging & Label Integrity

Products must arrive in packaging that accurately reflects their true manufacturer. We do not sell items that have been repackaged, relabeled, or altered to imitate the trade dress of a different brand than the one that actually produced the item inside.

Customer Authenticity Assurance

If a customer ever believes a delivered item is not genuine, we investigate the specific order and supplier source promptly and work toward a fair resolution under our Refund Policy. We do not require a customer to prove a negative to be taken seriously.

Ongoing Sourcing Risk Monitoring

We periodically reassess our supplier relationships. Any supplier later found to be a source of suspected counterfeit, unauthorized, or misrepresented goods is removed from our sourcing network, and every item connected to that supplier is delisted while we investigate.

How We Verify a Product Before It's Listed

Authenticity is checked at more than one point in our process — before a supplier is onboarded, before a product is listed, after inventory arrives, and continuously afterward as concerns are raised.

How We Use Brand Names & Trademarks on Our Site

Many of the products in our catalog — including hair care formulas, styling tools, and treatment serums — are manufactured by independent third-party brands rather than by Your Hair And Wig itself. When a brand name appears on one of these listings, it is there for one reason only: to accurately identify the company that actually manufactured that specific item, so customers know exactly what they are purchasing.

We do not use a manufacturer's name or logo to suggest that a different, unrelated product was made by that brand, and we do not use trademarked terms in a listing title or description in a way likely to confuse a customer about who actually produced the item.

Unless a written authorization, distribution agreement, or partnership genuinely exists with a brand, we do not describe ourselves as its "official," "certified," or "authorized" reseller, and we do not imply that a brand has reviewed, endorsed, or partnered with Your Hair And Wig. Where no such relationship exists, our listings describe the product factually, by what it is and what it does, without borrowing implied credibility from a brand relationship we do not have.

What We Will Never Claim

  • "Official" or "certified" reseller status for a brand we have no written agreement with
  • Endorsement, sponsorship, or partnership with a brand that has not granted one
  • Use of a brand name in a title to drive traffic to a different, unrelated product
  • Decorative use of a trademarked logo on a listing where no rights to do so exist

If You Are a Trademark or Copyright Owner

Human Hair Authenticity: What Our Claims Mean and How We Back Them Up

Hair-sourcing terminology carries real weight with customers, and both the FTC Act and Canada's Competition Act treat unsubstantiated origin or composition claims as a form of deceptive representation. We hold our human hair listings to a documentation-first standard: a claim is only published once the supplier has provided the basis for it.

The table to the right shows the terms most commonly used across our wig, lace front, weave, and extension listings, what each term means in plain language, and the type of supplier documentation we require before that term is allowed to appear on a product page.

If a customer ever receives a unit that does not match its listed fiber type or provenance claim, this is treated as a confirmed authenticity issue, not a styling preference dispute, and is resolved accordingly under our Refund Policy.

Claim We Use What It Means How We Substantiate It
100% Human Hair No synthetic fiber is blended into the unit; every strand is human hair. Supplier composition certificate on file
Remy Hair Cuticles remain intact and aligned root-to-tip in one direction, reducing tangling. Supplier processing documentation
Virgin Hair Not chemically permed, relaxed, or color-treated before collection from the donor. Written supplier sourcing attestation
Synthetic / Kanekalon Fiber Man-made fiber, never marketed or priced as human hair. Fiber type disclosed on every listing
Blended Human/Synthetic A defined mix of human hair and synthetic fiber in a single unit. Approximate blend ratio stated in the listing
Texture Naming (e.g., Brazilian, Peruvian) An industry-standard curl-pattern and texture classification — not a literal claim about the donor's home country unless stated separately. True country of manufacture disclosed on the label

A Note on Texture-Style Names

Terms like "Brazilian," "Peruvian," "Malaysian," or "Indian" appear widely across the hair industry as shorthand for a curl pattern and texture profile, not as a guarantee of where the donor hair was harvested. We use these terms only in that conventional, descriptive sense, and we separately disclose the true country of manufacture or processing on every applicable listing, consistent with US (19 U.S.C. § 1304) and Canadian (Textile Labelling Act, R.S.C. 1985, c. T-10) origin-marking requirements.

US & Canadian Legal Framework

Because we ship to both the United States and Canada, our counterfeit-prevention practices are designed to satisfy both federal systems. Here is the legal foundation behind our authenticity standards in each country.

United States
  • Lanham Act §32 & §43(a) (15 U.S.C. §§ 1114, 1125): Creates civil liability for trademark infringement and for false or misleading designations of origin or sponsorship in commerce.
  • 18 U.S.C. § 2320 (Stop Counterfeiting in Manufactured Goods Act, 2006): Makes it a federal crime to knowingly traffic in goods, labels, or packaging bearing a counterfeit mark, with penalties of up to $2,000,000 and 10 years' imprisonment for a first individual offense.
  • Tariff Act of 1930, § 526 (19 U.S.C. § 1526) & 19 C.F.R. Part 133: Authorizes U.S. Customs and Border Protection to detain, seize, and forfeit imported merchandise bearing a counterfeit mark recorded with CBP.
  • FTC Act § 5 (15 U.S.C. § 45): Prohibits unfair or deceptive acts, including false claims of authenticity, brand affiliation, or certified-reseller status.
  • Textile Fiber Products Identification Act & Hair Fiber Products Labeling provisions (15 U.S.C. §§ 70–70k; 16 C.F.R. Part 257): Require truthful, substantiated fiber-content disclosure on wigs, weaves, and extensions.
  • 19 U.S.C. § 1304: Requires country-of-origin marking on imported articles, including hair products and packaged accessories.
Canada
  • Trade-marks Act (R.S.C. 1985, c. T-13): Provides civil and criminal remedies for dealing in counterfeit trademark goods, including the offence and penalty provisions added by the Combating Counterfeit Products Act.
  • Combating Counterfeit Products Act (S.C. 2014, c. 32): Amended the Trade-marks Act and Copyright Act to add new civil and criminal remedies and new border-detention measures for counterfeit and pirated goods.
  • Customs Act (R.S.C. 1985, c. 1 (2nd Supp.)), s. 101: Gives the Canada Border Services Agency authority to detain shipments suspected of bearing counterfeit trademarks or pirated copyrighted works.
  • Trade-marks Act s. 51.06 & Copyright Act s. 44.02: Allow a rights holder to file a Request for Assistance (RFA) with the CBSA so that suspected counterfeit shipments can be flagged and reported to them.
  • Competition Act (R.S.C. 1985, c. C-34), ss. 52 & 74.01: Prohibits false or misleading representations about a product's authenticity, origin, or brand affiliation, whether pursued criminally or civilly.
  • Textile Labelling Act (R.S.C. 1985, c. T-10): Requires fiber content and country-of-origin disclosure, in English and French, on textile products including wigs, weaves, and scarves shipped to Canada.
